1. About these terms
These Terms of Use govern your access to and use of the brandrep.io website, platform and services (the "Platform"). By creating an account, booking a creator, subscribing, or otherwise using the Platform, you agree to these terms. If you do not agree, please do not use the Platform.
2. Who can use the Platform
You must be at least 18 years old and able to form a binding contract. Brand accounts must be used for a genuine business. Creator accounts must be operated by the individual creator or an authorised representative. You are responsible for keeping your login credentials secure and for all activity under your account.
3. What brandrep does
brandrep connects brands and agencies ("Brands") with certified content creators ("Creators") for the production of advertising creative, and offers optional managed services, an influencer discovery tool, educational content, and a certification program. brandrep facilitates these connections and transactions. Except where we expressly provide a managed service, brandrep is not the author of creator content and does not guarantee any particular advertising outcome, reach, engagement, or return.
4. Bookings, pricing and payment
Prices for creator deliverables are shown before you confirm an order and include a platform fee. You agree to pay the full amount shown at checkout. Payments are processed by third-party payment providers; by paying you also accept their terms. Funds for a booking may be held until you approve the delivered work, after which the Creator is paid, less the platform fee.
5. No refunds
All payments to brandrep, including booking payments, platform fees and subscription fees, are non-refundable. Because creator work is produced to order and access to educational and members-only content is granted immediately, we do not offer refunds, returns or cancellations once an order is placed or a subscription begins. Where a Creator fails to deliver agreed work, our sole obligation is to help re-assign the brief to another Creator or resolve the matter at our discretion; this does not create a right to a refund. Nothing here limits rights that cannot be excluded under applicable Indian law.
6. Subscriptions
Paid memberships renew automatically each billing period until cancelled. You can cancel at any time to stop future renewals; cancellation takes effect at the end of the current period, and, consistent with section 5, fees already paid are not refunded.
7. Creator content, rights and usage
Usage rights, whitelisting terms and licence durations for each deliverable are specified at the point of booking. Brands must use creator content only within the rights they have purchased. Creators warrant that their content is original, that they have secured all necessary permissions (including for any music, footage, or people featured), and that it complies with applicable advertising standards.
8. Acceptable use
You agree not to misuse the Platform, including by: submitting unlawful, misleading, infringing or harmful content; attempting to bypass the platform fee by transacting off-platform for connections made on it; scraping or reverse-engineering the Platform; or violating the advertising policies of Meta or any other channel. We may suspend or terminate accounts that breach these terms.
9. Certification
Certification indicates completion of our program at a point in time; it is not a guarantee of income, bookings, or performance. We may update, expire, or revoke certification, including where a creator's conduct or work quality warrants it.
10. Disclaimers and liability
The Platform is provided "as is". To the maximum extent permitted by law, brandrep excludes implied warranties and is not liable for indirect or consequential losses, lost profits, or advertising results. Our total liability for any claim is limited to the platform fees you paid to brandrep for the transaction giving rise to the claim.
11. Governing law
These terms are governed by the laws of India, and the courts of Bengaluru, Karnataka have exclusive jurisdiction.
